These Terms & Conditions ("Terms") govern the use of the AVX Dental website and all services, products, digital workflows, designs, surgical guides, and restorations provided by AVX Dental ("AVX," "we," "our," or "us"). By accessing our website, submitting a case, transmitting digital files, or engaging our services, you agree to these Terms.

1. Acceptance and Scope

These Terms apply to all laboratory services, products, digital designs, implant-supported restorations, surgical guide services, and interactions with AVX Dental.

Any terms proposed by a Customer that conflict with these Terms shall not apply unless expressly agreed to in writing by AVX Dental.

Our acceptance of a case, prescription, scan, or order does not waive these Terms.

2. Services and Orders

All orders must include complete and accurate information necessary for fabrication, including prescriptions, scans, photographs, models, implant specifications, and other relevant records.

AVX Dental reserves the right to refuse, postpone, or cancel any case that contains incomplete information, incompatible files, or conditions that may compromise the predictability or quality of treatment.

Pricing quotations are valid for thirty (30) days unless otherwise specified.

All turnaround times are estimates and may vary based on case complexity, revisions, material availability, shipping carriers, and communication delays.

3. Payment Terms

Payment terms are established upon account approval.

AVX Dental reserves the right to require deposits, prepayment, or a valid credit card on file for certain services or products.

Past-due balances may be subject to finance charges at the maximum rate permitted by applicable law.

Accounts with overdue balances may be placed on hold until payment is received in full.

Customers are responsible for all collection costs, including reasonable attorney's fees and expenses incurred in collecting unpaid balances.

4. Digital Workflow and File Submission

AVX Dental utilizes advanced digital workflows, CAD/CAM technology, and digital manufacturing systems.

By submitting digital scans, STL files, DICOM files, photographs, or other case data, you authorize AVX Dental to design, modify, manufacture, and process restorations and related products necessary to complete the case.

The prescribing clinician is solely responsible for ensuring the accuracy, completeness, and quality of submitted files and records.

AVX Dental is not responsible for fabrication errors resulting from inaccurate or incomplete information provided by the Customer.

Digital records may be retained for quality assurance, reproduction, training, and operational purposes.

5. Surgical Guide Services

5.1 Scope of Service

AVX Dental provides digital planning support, design services, and manufacturing of surgical guides intended for use by licensed dental professionals.

Surgical guides are laboratory-manufactured devices designed to assist clinicians during implant procedures.

5.2 Clinical Responsibility

AVX Dental does not diagnose patients, prescribe treatment, or provide clinical care.

The prescribing dentist is solely responsible for treatment planning, implant positioning, surgical execution, patient safety, and verification of all designs before use.

5.3 Submission Requirements

Guided surgery cases may require:

  • CBCT/DICOM files
  • STL scans
  • Clinical photographs
  • Implant specifications
  • Additional treatment records as needed

Incomplete or incompatible data may result in case delays, additional fees, or cancellation.

5.4 Design Approval

For cases designed by AVX Dental, treatment plans and guide designs will be submitted for review and approval before manufacturing.

Once approved, additional revisions may require extra fees and revised turnaround times.

5.5 Warranty and Liability

AVX Dental warrants only that surgical guides will be manufactured according to the approved design specifications.

AVX Dental does not guarantee clinical outcomes, implant placement accuracy, treatment success, or patient satisfaction.

Clinical responsibility remains entirely with the prescribing clinician.

6. Shipping and Delivery

Products are shipped using third-party carriers selected by AVX Dental or the Customer.

Risk of loss and ownership transfer to the Customer when the shipment leaves our facility.

AVX Dental is not responsible for delays, damage, or loss caused by shipping carriers.

Customers should inspect all deliveries promptly and notify AVX Dental of any issues within seven (7) days of receipt.

7. Warranty and Remakes

AVX Dental warrants that its products are manufactured according to the approved prescription and design specifications.

Warranty coverage applies only to manufacturing defects and does not extend to:

  • Clinical adjustments
  • Changes in patient anatomy
  • Occlusal changes
  • Improper use
  • Product alterations performed by third parties
  • Treatment planning errors

Any warranty remedy is limited to repair, replacement, or remake at the sole discretion of AVX Dental.

AVX Dental shall not be liable for chair time, treatment delays, lost revenue, implant failure, patient dissatisfaction, or any consequential damages.

8. Intellectual Property

All proprietary workflows, designs, CAD/CAM files, treatment planning protocols, images, videos, educational materials, and website content remain the intellectual property of AVX Dental unless otherwise agreed in writing.

No content may be copied, reproduced, distributed, modified, or used without prior written permission.

Manufacturing data, design files, and production workflows created by AVX Dental remain the property of AVX Dental.

9. Privacy and Data Security

AVX Dental is committed to protecting patient and customer information.

Patient records, scans, prescriptions, photographs, and treatment-related data are used solely for case fabrication, treatment support, quality assurance, and customer service purposes.

AVX Dental does not sell personal information.

Information may be disclosed only when necessary to fulfill services or when required by law.

Website analytics, cookies, and related technologies may be used to improve website performance and user experience.

10. SMS Communications

By providing your mobile phone number to AVX Dental, you consent to receive SMS and MMS communications regarding:

  • Case updates
  • Shipping notifications
  • Scheduling
  • Customer support
  • Marketing communications

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Michigan.

Any dispute arising from these Terms or services provided by AVX Dental shall first be addressed through good-faith negotiations.

If the dispute cannot be resolved, it shall be submitted to binding arbitration in Macomb County, Michigan, in accordance with the rules of the American Arbitration Association.

12. Changes to These Terms

AVX Dental may update these Terms from time to time to reflect operational, legal, or regulatory changes.

The most current version will always be available on our website.

Continued use of our website or services constitutes acceptance of any revised Terms.
